Terms of Service

1. Agreement to Terms

By accessing or using PostPilot ("the Service"), operated by PostPilot ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

2. Description of Service

PostPilot is an AI-powered social media content creation platform that:

  • Scans your website to extract brand information including colors, fonts, images, and business details
  • Generates social media posts, captions, and designs using artificial intelligence
  • Stores and manages your brand assets, photos, and content
  • Provides export-ready designs for platforms including Instagram, Facebook, LinkedIn, X (Twitter), and Google Business Profile

3. Account Registration

To use PostPilot, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials and not share them with others
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activity that occurs under your account

You must be at least 18 years old to create an account and use the Service.

4. Subscription and Payments

  • PostPilot is offered as a paid subscription service. Pricing, features, and usage limits are displayed at the time of purchase.
  • Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date.
  • All payments are processed through a third-party payment provider. By subscribing, you also agree to their terms of service.
  • We reserve the right to change pricing with 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.
  • Refunds are handled on a case-by-case basis. Contact us at postpilothq@proton.me to request a refund.

5. Your Content

"Your Content" refers to any data you provide to PostPilot, including but not limited to:

  • Website URLs submitted for scanning
  • Business information (name, address, phone, description)
  • Photos, logos, and other images you upload or that are extracted from your website
  • Brand settings (colors, fonts, tone, voice)
  • Prompts and instructions you provide to generate content

You retain full ownership of Your Content. By using the Service, you grant us a limited, non-exclusive license to use, store, process, and display Your Content solely for the purpose of providing and improving the Service.

6. AI-Generated Content

  • Content generated by PostPilot (designs, captions, hashtags) is created using artificial intelligence and is provided to you for your use.
  • You own the rights to AI-generated content created through your account and may use it for personal or commercial purposes.
  • AI-generated content is provided "as is." We do not guarantee that generated content is free from errors, factually accurate, or suitable for any particular purpose.
  • You are responsible for reviewing all AI-generated content before publishing or distributing it.
  • We are not liable for any claims, damages, or losses arising from your use of AI-generated content.

7. Website Scanning

When you provide a website URL for scanning, you represent and warrant that:

  • You own or have authorization to scan the website and use its content
  • The website content does not infringe on any third-party intellectual property rights
  • You consent to PostPilot accessing and extracting publicly available information from the website, including text, images, colors, fonts, and metadata

PostPilot accesses only publicly available content and does not bypass any authentication, paywalls, or access restrictions.

8. Acceptable Use

You agree not to use PostPilot to:

  • Create content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Infringe on the intellectual property rights of others
  • Generate spam, misleading content, or deceptive advertising
  • Scan websites you do not own or have permission to access for brand extraction
  • Attempt to reverse-engineer, decompile, or extract the underlying AI models or algorithms
  • Resell, redistribute, or sublicense access to the Service without our written consent
  • Interfere with or disrupt the Service or its infrastructure
  • Use automated tools, bots, or scripts to access the Service beyond normal usage

9. Usage Limits

Your subscription includes a specified number of posts per billing period. Usage limits reset according to your billing cycle. If you exceed your usage limit, you will need to wait for the next reset or upgrade your plan. We reserve the right to enforce fair usage policies to prevent abuse.

10. Intellectual Property

PostPilot, including its design, code, AI models, branding, documentation, and all related intellectual property, is owned by us and protected by applicable copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without prior written permission.

11. Third-Party Services

PostPilot relies on third-party service providers for AI processing, cloud storage, payment processing, and other infrastructure. Your use of the Service may involve the transmission of data to these providers as necessary to deliver our features. Each provider operates under its own terms of service and privacy policy, and we are not responsible for their practices or policies.

12. Termination

  • You may cancel your subscription and delete your account at any time through your account settings.
  • We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or fail to pay subscription fees.
  • Upon termination, your right to use the Service ceases immediately. We may delete your data, including brand assets, generated content, and account information, within 30 days of termination.
  • Sections regarding intellectual property, limitation of liability, and indemnification survive termination.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CONTENT GENERATED BY THE AI WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR YOUR NEEDS.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POSTPILOT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

15. Indemnification

You agree to indemnify and hold harmless PostPilot, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising out of or related to your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. If we make material changes, we will notify you via email or through the Service.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of competent jurisdiction.
